Registered Trademark

Epic AI® — U.S. Reg. No. 7,748,019

Class 42: SaaS featuring AI for use as an Intelligent Virtual Assistant

Relationship to Apache License 2.0

The Apache License 2.0 governs your rights to use, reproduce, modify, and distribute the source code of this project. Section 6 of the Apache License 2.0 explicitly states:

“This License does not grant permission to use the trade names, trademarks, service marks, or product names of the Licensor, except as required for reasonable and customary use in describing the origin of the Work.”

This trademark policy governs only the use of the Epic AI® name, logos, and associated marks. Nothing in this policy modifies, limits, or extends the code rights granted under the Apache License 2.0.

Nominative Fair Use

To accurately identify Epic AI® products, it may be necessary to refer to them by name. The basic rules for nominative fair use are: be accurate and not misleading, use only the word mark (not logos), and do not use the mark more prominently or frequently than necessary.

Permitted nominative fair uses include:

  • “You can install Epic AI® Chariot under Elastic License 2.0 from github.com/protectnil/epic-ai-chariot.”
  • “Our product is compatible with @epicai/chariot.”
  • “I recommend Epic AI® Chariot for federated enterprise orchestration.”

Use of the Epic AI® name in any nominative context does not imply endorsement, sponsorship, or affiliation with protectNIL Inc.

Derivative Works

Elastic License 2.0 grants you the right to use, copy, distribute, and modify Epic AI® Chariot subject to the ELv2 limitations (no hosted-resale, no functional disablement of license-key functionality, no removal of attribution). Trademark rights are independent of copyright; whether your fork is permitted by ELv2 or not, the following trademark guidelines apply:

  • Use a different name. You may not call your derivative work “Epic AI” or any confusingly similar name. You may refer to it only as “a derivative work of,” “derived from,” or “compatible with” Epic AI® Chariot.
  • Remove all branding. Remove the Epic AI® logo, hexagon device, and any associated trade dress from your distribution.
  • Provide clear attribution. State that your version is modified and not endorsed by protectNIL Inc.

Logos and Visual Marks

The Epic AI® logo and hexagon device are not licensed under the Apache License 2.0. You may not use, reproduce, or create derivative works of Epic AI® logos, or adopt confusingly similar visual marks, without written permission from protectNIL Inc.

Domain Names and Social Media

You may not use Epic AI® trademarks in domain names, social media account names, or handles without written permission from protectNIL Inc. Use of trademarks in domain names is not considered nominative fair use because the domain name refers to your offerings, not merely to our products.
